In a recent development, the Delhi High Court has declined to entertain a petition requesting the removal of Arvind Kejriwal from his position as the Chief Minister of Delhi.

As reported by India Today, the division bench of the Delhi High Court asserted that the decision of whether Kejriwal should continue as the CM or not was solely his personal prerogative.

This marks the second instance where the High Court has dismissed a petition aimed at removing Kejriwal from his CM post.

The court directed the petitioner to approach constitutional authorities for such matters.

“At times, personal interest has to be subordinate to national interest, but that is his (Kejriwal’s) personal call,” the High Court said.

The petition, filed by Vishnu Gupta, the national president of the Hindu Sena, was subsequently withdrawn by the petitioner.

Gupta stated his intention to present his case before the Lieutenant Governor instead.

The petitioner’s counsel argued that Kejriwal’s arrest had resulted in a governmental vacuum in the national capital.

However, the High Court mentioned that it was within the jurisdiction of the Lieutenant Governor or the President to address such concerns.

The court also underscored that the LG possessed the authority to determine whether the government was functioning adequately, reiterating that it was not the court’s role to interfere in executive matters.
